Domestic Partnerships and Relationship Recognition
A Domestic Partnership Agreement is a document that explains the contractual legal rights and
responsibilities of each partner when a couple decides to form a long-term committed
relationship, own real property together and start their own family unit. In the event of
potential disputes or misunderstandings regarding children of a same sex relationship, a
domestic partnership agreement can provide guidance for the allocation of parental rights and
responsibilities, child support and parenting time prior to the commencement of litigation.
Colorado does recognize the 'psychological parent' and a domestic partnership agreement can
clarify the relationship of the non-biological, second adopted parent.
Second Parent Adoption
If one partner is the sole legal custodian of a child (either through adoption or child birth) the
other partner may seek a second parent adoption through the District Court, thereby rendering
the non-biological parent (or non-adoptive parent) the same legal rights and the ability to care
for that child, to pick up the child from school, enroll them in school or make any medical
decisions for the child. A Second Parent Adoption allows the non-biological parent to seek
allocation of parental rights and responsibilities in court should the relationship between the
parents be terminated.
